A person becomes an unlawful non-citizen if they remain in Australia without a valid visa. This generally happens when a person overstays their visa or they had their visas cancelled for character reasons. A baby born to an unlawful non-citizen inherits the unlawful status.
If you stay in Australia even after your visa has expired, you will become an unlawful non-citizen and can be deported from Australia. In some cases, this can attract a three-year ban from being granted another Australian visa.
But some cases have a happy ending.
A client came to Australia on a temporary work visas (482) but the employer did not give her any work once she arrived in Australia. The employer lied to her about the work and demanded money from her to “pay for her tax”. She paid him thousands of dollars in cash as she was frightened. She worked illegally at another establishment for 2 years on a cash basis to survive.
Finally she came to us and we resolved her issues AND because we are lawyers, were were able to inform her that she can sue the employer for breach of contract and get damages.
